Testing on Arrest and/or Charge

Testing an individual on arrest and/or charge enables the police to identify adults misusing specified drugs earlier in their contact with the criminal justice system, so that they may be steered into treatment and away from crime as soon as possible. Individuals can be tested at post-arrest, rather than just post-charge, ensuring that those who misuse drugs but are not charged with an offence are nevertheless helped to engage in treatment and other programmes of help.

UK Home Office Drug Testing on Arrest and/or Charge

The Home Office have chosen to use our Mobile Test Systems and laboratory services for drug testing in custody suites since 2001. Drug testing is conducted in over 150 police stations across England and Wales using the SoToxa™ Mobile Test System employing software customised to Home Office requirements. An individual will be tested on arrest and/or charge where they fulfil all of the following conditions:

  • are aged 18 or over;
  • are in police custody;
  • and were arrested for a trigger offence or for an offence where a police officer of Inspector rank or above suspects specified Class A drug use was a causal or contributory factor.

Trigger offences are offences that are commonly associated with drug abuse and generally involve stealing, fraud or drugs, including:

  • Theft and attempted theft
  • Robbery and attempted robbery
  • Burglary and attempted burglary
  • Aggravated Burglary
  • Handling stolen goods and attempting to do so
  • Taking a conveyance without owners consent/authority (‘TWOC’)
  • Aggravated TWOC
  • Going equipped for burglary or theft
  • Fraud and attempted fraud by false representation, failing to disclose information, or by abuse of position
  • Possession of articles for use in frauds
  • Making or supplying articles for use in frauds
  • Begging and persistent begging
  • Possession of a specified controlled drug
  • Production or supply of a specified controlled drug
  • Possession of a controlled drug with intent to supply where that drug is a specified class A drug
